Virginia Passes Law Requiring Allergen Markers on Delivery, Takeout Foods

On April 13, Virginia Governor Abigail Spanberger signed a bill into law that requires identifying markers on delivery or takeout food prepared with alterations or substitutions to accommodate a customer-identified food allergy. The law comes into effect July 1, 2026.
Specifically, Senate Bill 183 states that “all restaurants that alter or substitute food due to a consumer-identified food allergy or sensitivity [must] place an identifying marker consistent with the standards established by the [Virginia] Board of Health on any food item prepared for delivery or carry out service that has been altered or substituted.”
