EU Publishes Guidance for Industry on New Packaging Law

The European Commission has published guidelines on the implementation of the Packaging and Packaging Waste Regulation (PPWR) to facilitate the uniform application of the new packaging rules across the EU and simplify compliance.
Adopted in February 2025, PPWR limits per- and polyfluoroalkyl substances (PFAS) in food packaging, bans single-use plastics for fruit and vegetables under a certain weight, and sets forth other changes, with the goal of addressing the environmental challenges caused by packaging waste. PPWR has transition periods for different requirements beginning as early as August 12, 2026.
The new guidance document clarifies provisions that need further interpretation and areas where stakeholders have requested assistance. For instance, it clarifies when a company is considered a manufacturer or producer, as well as which items are considered “packaging” under the regulation.
The document also spells out the restrictions on single-use packaging, enforcement of the PFAS restriction in food contact packaging, and the application of reuse targets. Moreover, it provides guidance on how to apply extended producer responsibility (EPR) for packaging and on the obligation to set up deposit and return systems.
The accompanying Frequently Asked Questions (FAQs) address a wide range of practical issues raised by stakeholders since the adoption of the PPWR in 2025. The Commission will update the FAQ document as needed.
The guidance document and the FAQs do not replace, add to, or amend the provisions of the PPWR.
Forthcoming Implementing Acts
The guidance document will be translated into all EU official languages before being formally adopted.

Additionally, the Commission will continue to monitor and facilitate the implementation of PPWR.
Several delegated and implementing acts are being prepared, including provisions on harmonized registration and reporting formats for EPR, labeling for waste sorting by consumers, recycled content in plastic packaging, and recyclability criteria. Member States, stakeholders, and trading partners are being consulted in the development of these acts.
