FDA Commissioner Steps Down, To Be Replaced by Agency’s Human Foods Leader

Marty Makary, M.D., has been ousted as the Commissioner of the U.S. Food and Drug Administration (FDA). He will reportedly be replaced by the agency’s Deputy Commissioner for Human Foods, Kyle Diamantas, J.D.
The news was first reported by Politico, which received the news tip from an anonymous White House source.
Despite Dr. Makary only holding his office at FDA for 13 months, the Trump Administration official told Politico that his dismissal was already months in the making, citing tensions with President Donald Trump and U.S. Health Secretary Robert F. Kennedy Jr, as well as controversial decisions regarding drugs and vapes.
The final call to remove Dr. Makary from FDA was made by Secretary Kennedy, said the source.
Top Foods Official to Assume FDA Leadership Position
It is said that Mr. Diamantas, who has been the Deputy Commissioner for Human Foods since early last year, will assume the role of Acting FDA Commissioner following Dr. Makary’s departure from the agency.
Mr. Diamantas replaced former Deputy Commissioner for Human Foods Jim Jones in February 2025, after Mr. Jones resigned due to the Trump Administration’s “indiscriminate” layoffs affecting FDA and other government agencies.
Prior to joining FDA, Mr. Diamantas was a Partner at Jones Day in Miami, Florida, where he advised FDA-regulated industry clients on regulatory, compliance, and enforcement matters.
