New EU Maximum Levels for Contaminants in Foods: Aflatoxins, Metals, and More

The European Commission has set new maximum levels (MLs) for certain contaminants in food.

The new MLs are effective as of April 25, 2023. MLs for each contaminant in certain foods are laid out in Annex I of European Commission Regulation 2023/915, which replaces Regulation 1881/2006.

The regulation covers contaminants like:

Aflatoxins
Plant toxins
Metals and other toxic elements
Persistent pollutants such as perfluoroalkyl substances (PFAS)
Processing contaminants
Other miscellaneous contaminants such as nitrates.

The full list of contaminants and their respective MLs in certain foods, as laid out in Annex I, is as follows:

1	Mycotoxins

Herbal infusions (dried product) and ingredients used for herbal infusions (dried products) of exclusively anise seeds

‘Herbal infusions (dried product)’ refers to:

—	herbal infusions (dried product) from flowers, leaves, stalks, roots, and any other parts of the plant (in sachets or in bulk) used for the preparation of herbal infusion (liquid product); and

—	instant herbal infusions. In the case of powdered extracts, a concentration factor of 4 has to be applied.
