Lawsuit Filed Against FDA for Failure to Remove Phthalates From Food Contact Materials

Earthjustice sued FDA on behalf of consumer advocates that previously petitioned FDA to revoke food contact authorizations for 28 phthalates, and were denied. Although FDA since revoked authorizations for many of those phthalates and says the rest are under review, the plaintiffs hope their lawsuit will force a long-overdue safety reassessment.

FDA Defends Revoking Authorizations for Most Phthalates; Remaining Uses Under Review

The U.S. Food and Drug Administration (FDA) has answered objections to a 2022 final rule revoking food contact uses of most phthalates, as well as objections to another petition urging FDA to revoke authorizations for all phthalate uses. The agency stands by its original decisions on both petitions, but reminds that phthalates are undergoing a safety reassessment by FDA.

A recent study comparing the presence of chemical contaminants in conventionally and hydroponically grown produce found pesticide residues and toxic heavy metals in a larger number of conventional samples than in hydroponic samples. High Levels of Toxic Plasticizers Phthalates, Bisphenols Found in Nearly All Foods in U.S.

Recent testing for phthalates and bisphenols like BPA in foods found all but one sample to contain phthalates and 79 percent of samples to contain bisphenols. Phthalates were present at worryingly high levels, although levels of bisphenols have decreased since 2009. The study was conducted by Consumer Reports.
